Construction, preliminary consultation
If you have a construction plan and are unsure whether an environmental permit can be granted for it, it may be useful to request a preliminary consultation. During a preliminary consultation, the feasibility of your plan will be assessed. You will receive a conclusion on your preliminary consultation.
If your original plan proves impossible, but the municipality sees possible solutions for realizing the plan in a modified form at your address, these solutions will be shared with you in the conclusion of the preliminary consultation. You will also receive points for attention for a possible permit application.
In short: A preliminary consultation is a useful tool for deciding whether you want to apply for a permit. It also helps you to prepare your permit application properly.
What is a preliminary consultation not intended for?
Small construction plans that do not conflict with the zoning plan. These include items such as solar panels, dormer windows, air conditioning units, heat pumps, replacing window frames, roller shutters, awnings, removing chimneys, driveways, maintenance, sustainability measures, etc. For such plans, it is often quicker to apply for a permit directly.
How are the preliminary discussions going?
When you submit your plan via the Omgevingsloket, it will first Omgevingswet to the Omgevingswet case manager. The case manager will check:
- Whether your building plan meets the application requirements;
- Whether your plan could be realized without a permit;
- Whether there is a deviation from the rules of the environmental plan.
If there are no deviations, or only a minor deviation from the rules in the environmental plan, the case manager of the environmental permits team will further assess your application.
If your plan requires a significant deviation from the environmental plan, your plan will be transferred to the Spatial Planning unit. A more extensive process will then be required. You will be notified of this.
