Intention to enter into a leasehold right of superficies, Stadhoudersplein 1A

The municipality of Wassenaar intends to enter into a new (extension) agreement for a rent-dependent right of superficies with the current tenant for the purpose of operating a fish kiosk. This concerns the plot of land, known in the land registry as Municipality of Wassenaar, B11274 (partially, locally known as Stadhoudersplein 1A in Wassenaar, measuring approximately76m2.

Operator is the only serious candidate

In the opinion of the municipality, the operator is the only serious candidate eligible for the above leasehold right for the purpose of operating the fish kiosk at the aforementioned location. This concerns a sitting tenant. In addition, the operator has made investments that give the sitting tenant's interests greater weight.

In view of the above, the municipality is of the opinion that, based on objective, reasonable, and verifiable criteria, only one serious candidate is eligible for the aforementioned rent-dependent right of superficies. It should be noted that the municipality has a considerable degree of discretion in this matter. 

Expiration date 

If you do not agree with this intention, you must notify us of this by 12 noon on December 28, 2025 (within 20 calendar days of publication) by sending a reasoned message to juridischezaken@wassenaar.nl, quoting the reference "rent-dependent right of superficies Stadhoudersplein 1A." In the absence of a timely and reasoned message, the right to take legal action against all of the above and/or to base any claim for compensation or any other claim whatsoever on it will lapse, or at least you will have forfeited your rights to it. After all, the municipality and the operator would be unreasonably disadvantaged if, only after this (clearly communicated) deadline, the intention or the conclusion of the agreement(s) were to be challenged. 

With this publication, the municipality is implementing the ruling of the Supreme Court dated November 26, 2021 (ECLI:NL:HR:2021:1778).
