Intention to establish a right of superficies located near Havenkade 71

The municipality of Wassenaar intends to enter into an agreement with Niersman Projectontwikkeling B.V. for the establishment of a right of superficies on part of the plot known in the land registry as municipality of Wassenaar, section B, number 12377, located near Havenkade 71 in Wassenaar. The right of superficies is granted for the purpose of constructing and maintaining a jetty. 

The municipality believes that in this case there is only one serious candidate for establishing the right of superficies, namely Niersman Projectontwikkeling B.V., which has also built an apartment complex on the adjacent site. The jetty forms an integral part of the area development.

In view of this, the municipality has decided not to hold a public selection procedure.

If you do not agree with this intention, you must notify us within 20 calendar days of the publication date of this notice by sending a reasoned message to juridischezaken@wassenaar.nl, stating "Response to Didam publication Havenkade." In the absence of a timely and reasoned message, the right to take legal action against all of the above and/or to base any claim for compensation or any other claim whatsoever on it will lapse, or at least you will have forfeited your rights to do so. After all, the municipality and the developer would be unreasonably disadvantaged if the intention or the conclusion of the agreement(s) were to be challenged only after this (clearly communicated) deadline. With this publication, the municipality is implementing the judgment of the Supreme Court dated November 26, 2021 (ECLI:NL:HR:2021:1778).
