Holding municipality liable

How does it work?

Requirements:

  • The damage suffered is due to the municipality.
  • The municipality failed to comply with a written or unwritten rule of law.
  • There is a direct connection between the municipality's culpable act or omission and the damage you have suffered.
  • Incomplete damage reports will not be considered by the municipality.

State of roads

For damage caused by the condition of roads, paths and sidewalks, the municipality is only liable if the road is dangerous or defective and the municipality is to blame. There can always be minor irregularities or differences in elevation.

What to do

Holding the municipality liable can only be filed online.

You complete the online digital liability form. It is important that you properly substantiate the liability.

  • Overview photo and detail photo of the damage
  • Well itemized claims report or budget
  • Original purchase receipt of the damaged item
  • For cars :expert report from authorized garage
  • Situation outline, if applicable
  • Police report, if applicable
  • Witness statement, if applicable

If necessary, the municipality may ask for additional information.

How long does it take?

Processing time is 8 weeks.
